Plow Purchase Approved, Bloomfield Drive Resident Concerned and Jennnifer Madore Appointed to Youth Commission

The Peru Gazette did not cover the Town Board Meeting of November 9, 2013.   The meeting included  a complaint from Bloomfield Drive resident Lindsey Wendorff regarding her concern about a situation on her street. Here is that portion of the approved minutes.

Lindsey Wendorff – 42 Bloomfield Drive. Ms. Wendorff addresses the board and refers to a letter of concern that she (and her husband) had mailed to all board members.  Members of the board confirmed that they had received her letter and were aware of her concerns.  The letter described their “grave concerns” regarding the snow plow turn-around that is on the back side of their property.  The letter identifies such as a private trash company worker parking in the turn-around and defecating on the asphalt, a local school teacher smoking and leaving cigarette butts on the ground, an old television dumped and left and used condoms and empty beer bottles also found along the road.  They also describe random cars and strangers parking along the road at all hours.  These residents are concerned that their property is being used inappropriately and are asking for assistance from the town for a resolution. 

According to the meeting minutes the Board also authorized the purchase of a snow plow package for the Highway Department at a cost not exceed $71, 231 and appointed Jennifer Madore to the Peru Youth Commission.

Here are the complete meeting minutes. 

The regular meeting of the Peru Town Board was held on Monday, November 25, 2013 at the Peru Town Hall.  Those present were Mr. Pete Glushko, Supervisor; Mr. Kregg Bruno, Councilman; Mr. James Douglass, Councilman; Mrs. Susan Polhemus, Councilperson; Mr. Don Biggs, Town Attorney; Mrs. Kathleen Flynn, Town Clerk.  Also present Mr. Greg Timmons, Water/Sewer Superintendent; Mr. Michael Farrell, Highway Superintendent; Mr. Don McBrayer, Website Consultant;  and Ms. Pamela Barber, Secretary to the Board.

Excused; Mr. Brandy McDonald, Councilman.

The meeting was called to order at 7:02 PM by Mr. Glushko, with the Pledge of Allegiance.

Motion by Mrs. Polhemus, seconded by Mr. Douglass to approve the minutes from the November 1, 2013 Emergency Meeting.   Ayes 3 Nays 0                               Motion Carried 

Motion by Mr. Douglass, seconded by Mr. Bruno to approve the minutes from the November 4, 2013 meeting.  Ayes 4 Nays 0                                                                       Motion Carried 

Motion by Mrs. Polhemus seconded by Mr. Douglass to approve the minutes from the November 6, 2013 Public Hearing.  Ayes 3 Nays 0                                                     Motion Carried

Community Input and Questions

Approval of Jennifer Madore to the Peru Youth Commission

Motion by Mr. Douglass, seconded by Mrs. Polhemus accepting the recommendation from the Peru Youth Commission to appoint Jennifer Madore to the Peru Youth Commission, effective immediately.  Ayes 4 Nays 0        Motion Carried 

Approval of Purchase of TENCO Snowplow Package

Motion by Mr. Bruno, seconded by Mrs. Polhemus to pass resolution #13.11.25-1;

WHEREAS, The Town of Peru Highway Department has found a need for plow package for a new vehicle to be purchased, and

WHEREAS, the Town Board has been presented with a New York State Contract quote from TENCO Industries by the Town Highway Superintendent,  and,

WHEREAS, the Town Highway Accounts have sufficient funds to pay for said plow package, now

NOW BE IT RESOLVED, that the Town of Peru accepts the proposal of TENCO Industries dated September 16, 2013, for the New York State Bid price not to exceed Seventy One Thousand, Two Hundred and Thirty One Dollars and No Cents ($71,231.00) and approves purchase of the plow package , including installation for that amount and authorizes the Town Highway Superintendent to coordinate this purchase and the Town Supervisor to sign any related contract/agreement for this package following Town Attorney review.

Discussion-Mr. Farrell explains to the board that the state contract pricing is set to expire on November 30th.

Mrs. Polhemus asks how the town plans to fund this.  Mr. Farrell informs Mrs. Polhemus that the payment will begin when the plow package arrives.  Mr. Farrell also states that this is in the 2014 budget.

Clinton County Personnel Survey Letter

Mr. Glushko refers to a letter that he received from the Clinton County Department of Personnel requesting that town participate in a NYS Civil Service Classification Study.  Members discussed whether or not they wished to cooperate with the request and ultimately decided that Mr. Glushko would write a letter informing them that the Town of Peru is not interested in participating in the study.

Town Zoning Law Update

Mr. Biggs informs members of the board that he considers the change made to the Town Zoning Law significant enough to warrant another SEQR.  He has prepared two new resolutions.

Motion by Mr. Bruno, seconded by Mr. Douglass to pass resolution # 13.11.25-2;

WHEREAS, the Town Board of the Town of Peru (hereinafter referred to as the “Town

Board”” and/or “Town”) is considering the enactment of a Town Zoning Law to replace the

Ordinance currently in effect (hereinafter the “Project”); and

WHEREAS, the State Environmental Quality Review Act, (hereinafter referred to as the

“SEQRA”) of the Environmental Conservation Law provides for the review of projects which

constitute an “action” with respect to the effect of such projects on the environment; and

WHEREAS, New York Compilation of Codes, Rules and Regulations, Title 6, §617.6 requires

any agency proposing to undertake an action, such as the Project herein, to initially review the

action to determine whether such action is subject to State Environmental Quality Review

(“SEQR”), involves a Federal agency, involves one or more other agencies and to make a

preliminary classification of the action as Type I or Unlisted and to establish a lead agency.

NOW, THEREFORE, it is hereby

RESOLVED that the Project is subject to SEQR; and it is further

RESOLVED that the Project does not involve a Federal agency; and it is further

RESOLVED that the Project does not involve one or more other agencies; and it is

further;

RESOLVED that the Project is a Type I action; and it is further

RESOLVED that the Town of Peru is the lead agency for the Project for purposes of

assessing the effect of the Project on the environment and determining whether said effect is

sufficiently significant to require the preparation of a “Draft Environmental Impact Statement”.

THIS RESOLUTION shall become effective immediately upon its adoption by the

Town Board of the Town.

Motion by Mrs. Polhemus, seconded by Mr. Bruno to pass resolution #13.11.25-3;

WHEREAS, the Town Board of the Town of Peru (hereinafter referred to as the

“Town Board”” and/or “Town”) is considering the enactment of a Town Zoning Law to

replace the Ordinance currently in effect (hereinafter the “Project”); and

WHEREAS, the State Environmental Quality Review Act, (hereinafter referred to as

the “SEQRA”) of the Environmental Conservation Law provides for the review of

projects which constitute an “action” with respect to the effect of such projects on the

environment; and

WHEREAS the Project does constitute an “action” for purposes of SEQRA; and

WHEREAS this Board previously established itself as lead agency for the Project;

and

WHEREAS this Board previously determined that the Project was a Type I action;

WHEREAS the New York Compilation of Codes, Rules and Regulations, Title 6,

§617.7 states that the lead agency must determine the significance of any Type I action in

writing; and

WHEREAS the Board has before it a completed Full Environmental Assessment

Form, Part 1 and a proposed Full Environmental Assessment Form, Part 2 indicating that

the Project will have no impact on the 18 environmental areas of concern listed therein in

connection with the Project and a proposed Full Environmental Assessment Form, Part 3

indicating that the Project will result in no significant impact on the environment and that

therefore an environmental impact statement need not be prepared; it is now

RESOLVED that the proposed Full Environmental Assessment Form, Part 2 and Part 3

are adopted by this Board; and it is further

RESOLVED that the Project will not have a significant impact on the environment and

that the Board issue a Negative Declaration for the Project.

THIS RESOLUTION shall become effective immediately upon its adoption by the

Town Board of the Town.

Discussion– Mr. Bruno refers to paragraph seven “Whereas the board has before it a completed Full Environmental Assessment Form, etc.”  Mr. Biggs tells Mr. Bruno that it has been completed.  Mr. Bruno also asks if we need to do another Public Hearing and Mr. Biggs replies that we do not.  Mr. Glushko states that the New Zoning Law will hopefully be in place by the end of the year.

Laphams Mills Field Playground Contract Update

Mr. Douglass informs members of the board that he attempted to speak with Mr. Clowney but was not able to do so.  Mr. Bruno states that he had spoken to him and that he knows Mr. McDonald can contact him also. Mr. Douglass goes on to say that he feels that due to the time of the year, that the project will not be able to be completed this year.  Mr. Timmons states that it is his belief that the hole dug for the playground is too big and too deep.  He would suggest post holes instead of taking out the entire area.  With all of that being said, board members want to ensure that the area is fenced off for the Winter and hopes to move forward for completion in the Spring.

 

Water Quality Improvement Project Update

Mr. Timmons states that the above project is nearing full completion.  He refers to a few “punch items” left.  He also informs members of the board that the Clinton County Health Department came to view the facility and was very happy.

Safe Routes To Schools Kick Off Meeting

Mr. Glushko attended a meeting at Peru Central School last week regarding the above.  Presently the plan is to put some type of a flashing light on Route 22B.  Mr.  Glushko informs members of the board that the town will maintain the lights.

Highway Garage Roof Update

No update.

Town Hall Front  Entrance Update

No update.

Hudson Energy Update

Mr. McDonald is still investigating this issue.

Bloomfield Drive Issue

This is an extension of the Public Comment portion of the meeting.  Mr. Farrell informs members of the board that he is not entirely certain whether or not he can post “No Parking” on the road.  Mr. Biggs offers to review the map of the homeowners property, title and easements to see what the Town of Peru’s options are for this problem.

Other Business

Mr. Douglass states that he has been working closely with Patrick Holmes from the JCEO (located downstairs in the town hall) and commends him on the job he is doing.

Mr. Glushko  informs members of the board the five projects that Liz Tedford (Grant Coordinator) has submitted have made it to the second round for consideration.

He also refers to a bill for one of the puppies that was found abandoned during the Summer.  Mr. Glushko informs members of the board that the bill will be mailed to the Clinton County District Attorney’s Office.

Mrs. Flynn provides Mr. McBrayer with newly elected town council information (provided by New York State) which gives him the opportunity to register for meetings in the near future.

She also informs members of the board that the Christmas Tree Lighting is schedule for Friday, December 6, 2013 at 6:45.  Members of John Roach’s Family have been asked to light the Christmas Tree.

Mr. Biggs asks the board if they want him to review the Dog Control Law.

Public Comments on Agenda Items Only

Gordon Duprey suggests that the town send a letter to Hudson Energy informing them that they do not wish to participate with them.

Approve/Pay Bills

Motion by Mr. Bruno, seconded by Mr. Douglass to pass resolution #13.11.25-2;

WHEREAS, the Town Board has reviewed and audited the following claims, bills and invoices for services rendered and goods provided to the Town in November 2013: From Town Of Peru Vouchers: # 201301887  through and including  # 201302029 Abstract dated:  11/25/2013 For the dollar amount totaling:   $ 172,554.30; and WHEREAS, the Town Board finds said claims, bills and invoices to be acceptable in form and reasonable in amount; NOW, THEREFORE, BE IT RESOLVED, that payment of the aforementioned claims, bills and invoices is approved and the Supervisor be and hereby is authorized to make such payment; and be it further ESOLVED, that this Resolution shall take effect immediately.
