State Senate Approves Measure to Help Campgrounds Recover Costs

The State Senate today approved legislation that would allow campground owners to place liens on recreational vehicles (RVs) when guests fail to pay occupancy fees and other charges or abandon their vehicles. Senator Betty Little sponsored the bill (S.1684b) after hearing from the Campground Owners of New York (CONY).
“The main problem is people abandoning vehicles at campgrounds,” said Little. “These guests often also owe seasonal fees. Campground owners need a legal means, similar to storage facility owners, of recouping costs and getting rid of the abandoned property. This is particularly important if the owner of the RV has defaulted on it. Placing a lien would enable the campground owner to retain the RV until they are paid.” The legislation would enable a lien to be placed against a recreational vehicle if a guest is in default of paying occupancy fees and other charges for a period of 30 days.
The campground owner would be required to provide notice, served by certified mail, which advises that the guest is in default and his or her recreational vehicle will be removed from a campsite and that proceedings will be commenced to enforce a lien under article 9 of the lien law. The notice also would direct the guest to remove his or her personal property from the recreational vehicle.
