Approved minutes of Peru Town Board’s August 24th meeting

The regular meeting of the Peru Town Board was held on Monday, August 24, 2020, at the Peru Town Hall.  Those present were Mr. Brandy McDonald, Supervisor; Mr. Richard Barber, Councilman; Mr. Kregg Bruno, Councilman; Mr. James Douglass, Councilman; Mr. Mel Irwin, Councilman; Mrs. Dianne Miller, Town Clerk.  Also present Ms. Pamela Barber, Secretary to the Board; Mr. Courtney Tetrault, Water/Sewer Superintendent; Mr. Michael Farrell, Highway Superintendent; Mr. Dave Drollette, Dog Control Officer and Mr. John Flynn; Youth Director.

The meeting was called to order at 6:08 PM by Mr. McDonald, with the Pledge of Allegiance.

 

Motion by Mr. Irwin seconded by Mr. Bruno to accept the minutes from the August 10, 2020 Regular Meeting.

Community Input

Mr. Ryan asked the difference of grants versus loans- Mr. McDonald stated many factors were involved. The main factor is income level for each community. The process of obtaining grants is not clean cut.

Mr. Ryan also asked for a Washington Street update. Mr. Guynup stated the situation is in the hands of Mr. Sawyer (developer) as a full build-out addition needs to be done for the retention basin.

 

RESOLUTION NO.  20.08.24-1

 

RESOLUTION SETTING A PUBLIC HEARING TO ENACT A SOLAR ENERGY LOCAL LAW PURSUANT TO SECTIONS 261-263 OF THE TOWN LAW AND SECTION 20 NEW YORK MUNICIPAL HOME RULE LAW OF THE STATE OF NEW YORK.

MOTION BY: Mr. Barber      SECOND BY:  Mr. Bruno

 

WHEREAS, pursuant to Section 261-263 of the Town Law and Section 20 of the Home Rule Law of the State of New York, which authorize the Town to adopt zoning provisions that advance and protect the health, safety and welfare of the community and, by the Town Board of the Town of Peru on its own motion; and

WHEREAS, the Town Board wishes to enact a local law to create regulations for the installation and use of solar energy generating systems and equipment,

NOW THEREFORE BE IT RESOLVED, by the Town Board of the Town of Peru that a public hearing on the above proposed Solar Energy Local Law is hereby set for September 14, 2020 at 5:45 PM.

This Resolution shall take effect immediately and shall be dated August 24, 2020.

RESOLUTION NUMBER: 20.08-24-2

 

 

 

A RESOLUTION APPROVING THE MEMORANDUM OF UNDERSTANDING WITH CLINTON COUNTY HEALTH  DEPARTMENT FOR CLINIC SERVICES AND THE TOWN OF PERU AND AUTHORIZING THE SUPERVISOR TO EXECUTE THE SAME.

 

MOTION: Mr. Bruno                                  SECOND: Mr. Douglass

 

 

WHEREAS, the Town Board has the Memorandum of Understanding between Clinton County Health Department and the Town of Peru to provide a site for Clinic Services for the residents of Clinton County ,

 

THEREFORE, BE IT

 

RESOLVED, said proposed Memorandum of Agreement is approved and the Supervisor be and hereby is authorized to execute said contract, AND, BE IT

 

RESOLVED, that this Resolution shall take effect immediately.

Approval of Contract from Clinton County for Assessment Services

Ms. Barber stated the increase of $.75 in 2021; $.25 for 2022 and an additional $.25 in 2023.

 

RESOLUTION NUMBER: 20.08.24-3

 

 

MOTION BY:  Mr. Barber               SECOND BY:  Mr. Bruno

 

 

WHEREAS,    The Town of Peru supported by the Town of Peru Board Members; and

 

WHEREAS,     with support from Town of Peru Board, it is agreed that it is in the best interests of the Town of Peru to accept the 2021-2023 Contracted Agreement  with Clinton County Real Property Office for Assessment Services as stated on the attached contract; and

 

WHEREAS,   the Peru Town Board authorizes the Supervisor to sign the contract with Clinton County Real Property Office for Assessment Services as stated on the attached contract; for the Town of Peru agrees to pay the County a scaled fee of $14.50 (fourteen dollars and fifty cents) for 2021, $14.75 (fourteen dollars and seventy five cents) for 2022 and $15.00 (fifteen dollars) for 2023 for each parcel contained in the completed final assessment roll, with the total amount, for that year, due under this resolution, to be paid on or before August 1, each year.

 

NOW, THEREFORE,

 

BE IT RESOLVED,    that the Supervisor of the Board of the Town of Peru be and is hereby authorized to enter into the contract with Clinton County Real Property Office for Assessment Services as stated on the attached contract; for the Town of Peru in the scaled fee as outlined above, for each parcel contained in the completed final assessment roll, with the total amount, for that year, due under this resolution, to be paid on or before August 1, each year.

 

RESOLVED,  that this Resolution will commence on the 1st day of January 2021, and shall continue and include the 31st of December 2023.

A RESOLUTION ACCEPTING THE NEW RETENTION AND DISPOSITION SCHEDULE FOR NEW YORK LOCAL GOVERNMENT RECORDS (LGS-1).

 

 

Motion by:  Mr. Bruno                                Second by: Mr. Irwin

 

 

RESOLVED, By the Peru Town Board of the Town of Peru that the Retention and Disposition Schedule for New York Local Government Records (LGS-1), issued pursuant to Article 57-A of the Arts and Cultural Affairs Law, and containing legal minimum retention periods for local government records, is hereby adopted for use by all officers in legally disposing of valueless records listed therein.

 

FURTHER RESOLVED, that in accordance with Article 57-A:

(a) Only those records will be disposed of that are described in Retention and Disposition Schedule for New York Local Government Records (LGS-1), after they have met the minimum retention periods described therein;

 

(b) Only those records will be disposed of that do not have sufficient administrative, fiscal, legal, or historical value to merit retention beyond established legal minimum periods.

 

RESOLVED, that this Resolution shall take effect immediately.

A RESOLUTION TO PURCHASE  A PORTION OF LAND FROM PERU COMMUNITY CHURCH AS SHOWN ON SURVEY MAP DATED 6/10/20 BY SCOTT B. ALLEN, L.S. OF  AES NORTHEAST.

 

MOTION : Mr. Bruno                                                 SECOND: Mr. Barber

 

 

WHEREAS, THE Town of Peru finds it would be beneficial to purchase a portion of land owned by Peru Community Church for the erection of a new municipal sewage pump station.

 

WHEREAS, The Peru Town Board has received two estimates and has forwarded the copy of the same to the Peru Community Church along with survey map and Schedule A – Description, dated June 11, 2020 by Scott B. Allen, LS on June 18, 2020.

 

WHEREAS, the Town Board has determined that it is willing to purchase the said property with a counteroffer for an amount of $9,000 (Nine thousand dollars and no cents).

 

BE IT RESOLVED that the Town Supervisor is authorized to sign all paperwork to execute this purchase as soon as possible.

Possible paving of driveway into Lapham Mills Rec Building

Mr. Barber, speaking for Mr. Flynn, requested the paving of the driveway with the Capital Project funds. Mr. McDonald stated that there is no “Capital Project” account, just the Town Hall Building line item. Mr. Farrell informed the board at this time the Town’s paver was not available. The paver is being repaired at this time with hopes to locate the parts. Mr. Farrell recommended if it was to be done, to use just binder and no topcoat.

Other Business

Mr. Barber brought forth the idea from Mr. Flynn of the construction of a volleyball court at Lapham Mills Park. Mr. Flynn stated Greg Mills has a quote for $ 4286.00 which $ 2500.00 from Al Brault memorial would be used to offset the cost. Mr. Farrell stated he had the resource to obtain the sand for a much lower price. Discussion will continue at a later date.

 

Mr. Tetrault stated the Sprint antenna on the water tower is secured but not fixed. Mr. Tetrault hired a drone to inspect the tower for any possible damages to the Town’s tower.  None were apparent.

 

Mr. Farrell will be attending the New York State Highway Convention in Syracuse. A possible buyout offer for eligible retirees will be discussed.

 

Mr. Flynn stated the Blaise boys will be done this Friday. He commended them on a great job on painting the backstops and dugouts at Lapham Mills Park.

A RESOLUTION AUTHORIZING THE POST-AUDIT PAYMENT OF CERTAIN CLAIMS, BILLS AND INVOICES OF THE TOWN

WHEREAS, the Town Board has reviewed and audited the following claims, bills and invoices for services rendered and goods provided to the Town in August 2020:

 

From Town of Peru Vouchers in August 2020; #202000864   through and including #202000923,

 

Abstract dated 8/24 /2020

 

 

For the dollar amount totaling: $123,270.33, of that, $12,879.76 was wired, credit cards and prepaid; and $110,390.57is remaining to be paid and

 

WHEREAS, the Town Board finds said claims, bills and invoices to be acceptable in form and reasonable in amount;

 

NOW, THEREFORE, BE IT

 

RESOLVED, that payment of the aforementioned claims, bills and invoices is approved and the Supervisor be and hereby is authorized to make such payment; and be it further

 

RESOLVED, that this Resolution shall take effect immediately.
